Service Terms

By engaging Megacity Heating & Air Conditioning for HVAC services, you agree to the following terms and conditions. These terms apply to all residential and commercial HVAC services we provide, including installation, repair, maintenance, and consultation.

• All work is performed by TSSA-certified, licensed, and insured technicians.
• A homeowner or authorized representative aged 18 or older must be present at the service location during all scheduled appointments.
• The customer is responsible for providing safe and reasonable access to all HVAC equipment requiring service.
• We reserve the right to decline or discontinue service if working conditions are deemed unsafe or if the scope of work changes materially from the original agreement.

Estimates & Pricing

• All estimates provided by Megacity Heating & Air Conditioning are free of charge and given in good faith based on the information available at the time of assessment.
• Estimates are valid for 30 days from the date of issue, unless otherwise stated in writing.
• Final pricing may differ from the initial estimate if unforeseen conditions, additional work, or code compliance requirements are discovered during the course of service. Any changes will be communicated and approved by the customer before proceeding.
• Payment is due upon completion of service unless alternative payment arrangements have been agreed to in writing.
• We accept cash, cheque, e-transfer, and major credit cards.

Warranty

Megacity Heating & Air Conditioning stands behind the quality of our work. Our warranty terms are as follows:

• Labour warranty: All installation and repair work is covered by a minimum one-year labour warranty from the date of completion.
• Equipment warranty: New HVAC equipment is covered by the manufacturer's warranty. Warranty terms vary by manufacturer and product line. We will assist you with all warranty claims and registration.
• Parts warranty: Replacement parts used during repairs carry the manufacturer's warranty, which we will honor on your behalf.
• Warranty coverage is void if the equipment has been tampered with, modified, or serviced by unauthorized personnel after our installation or repair.
• Regular maintenance is recommended to maintain warranty eligibility. Neglecting routine maintenance may void certain warranty protections.

Limitation of Liability

To the maximum extent permitted by applicable law:

• Megacity Heating & Air Conditioning shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to our services.
• Our total liability for any claim related to our services shall not exceed the total amount paid by the customer for the specific service giving rise to the claim.
• We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including but not limited to severe weather, supply chain disruptions, utility outages, or government restrictions.
• We are not responsible for pre-existing conditions, defects, or damage to your HVAC system, property, or infrastructure that are not directly caused by our work.

Cancellation Policy

• Scheduled service appointments may be cancelled or rescheduled free of charge with at least 24 hours' notice.
• Cancellations made with less than 24 hours' notice may be subject to a service call fee.
• For installation projects where equipment has already been ordered, cancellation may be subject to restocking fees imposed by the manufacturer or supplier.
• Emergency service calls are non-cancellable once a technician has been dispatched.

Governing Law

These terms of service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from or related to these terms or our services shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.

Megacity Heating & Air Conditioning operates in compliance with all applicable municipal, provincial, and federal regulations, including but not limited to the Technical Standards and Safety Act (TSSA), the Ontario Consumer Protection Act, and the Personal Information Protection and Electronic Documents Act (PIPEDA).
